USPTO Patent Continuation Application
Summary
Freelancer Client is hiring: USPTO Patent Continuation Application.
Location: Remote
My UK-based startup filed a patent for a medical device in the UK in 2020, before taking it via the PCT route to the European Patent Office and the USPTO. It is still pending in Europe, but in the US it is due to be issued on the 3rd June. I have however, held off paying the Issue Fee because I had been hoping to file a continuation application. In the US we went back and forth with the examiner and had to make some amendments that limit the scope of the patent. By December 2025 we had submitted an amendment that the examiner responded to in February. The examiner felt that the December 2025 amendment addressed the prior art he had previously identified, but he then declared some newly identified prior art. The examiner suggested an adjustment to claim 1 that he would allow the patent on. I do want to proceed and 'bank' an issued US patent even with this narrowed claim 1 from February. However, I also want to use the continuation application to present arguments that the examiner added that February addition unreasonably and that the version of the claims submitted in December should be allowable.
I have been working with a patent attorney firm in London, who also engaged a US firm. While I am asking them to proceed with the Issue Fee, I cannot afford them to conduct the continuation application. If I were to supply the version of the claims from December 2025 and my arguments as to why I feel they should be allowed, is this something you could turn into a continuation application? If so, how much would this process cost? For reference, my company is a micro entity.
I am looking for a US Agent or US Patent Attorney who can take my arguments and provide any necessary re-writing of them and then use them in addition to my claims from December to prepare and file all necessary USPTO forms (Transmittal, ADS, etc.) before the June 3rd deadline.as part of the continuation application.
